Legal proceedings regarding damages for a casino in close proximity to the 2023 Formula One Grand Prix track were ongoing on Thursday, with a Clark County judge determining that more information is necessary to decide the fate of the case.
The owners of Ellis Island hotel-casino, situated just north of the Formula One Paddock Building on Koval Lane, initiated a lawsuit in April against the Las Vegas Grand Prix and Clark County, seeking compensation for the adverse effects of the inaugural racing event. They claimed to have suffered multimillion-dollar losses due to road construction related to the race which impeded access to the hotel-casino in the months leading up to the November 2023 event dates.
During the hearing, attorneys representing the race and the county asked the District Court to dismiss the case.
Clark County’s attorney, Agnes Hanley, argued to Judge Joanna Kishner, stating, “The problem is that while we may have had actual and real frustrations with traffic and access during the construction of all the improvements that were necessary for the 2023 Grand Prix race, even during the race, these inconveniences — even if they impacted their business — they’re not compensable under our constitution.”
Judge Kishner ruled that the business’s attorneys needed to provide more detailed complaints to support the continuation of the case.
The legal team representing Ellis Island alleged that race officials deliberately restricted access to the casino in violation of Nevada law. However, the law specifies that “total obstruction” is prohibited, and the complaint lacks specifics about instances of complete lack of access to the site. Judge Kishner determined that the case could proceed, but called for clarification.
The timeline for further court appearances by the involved parties remains uncertain. The attorneys agreed to collaborate and present deadline dates to the court for an amended complaint and other related filings.
Ellis Island is not alone in seeking financial recompense for losses incurred during the Formula One event. Attorneys representing the Italian restaurant Battista’s Hole in the Wall and Stage Door Casino, situated behind the Flamingo, also filed a lawsuit on Tuesday seeking damages for the millions of dollars lost due to road construction impeding access to the property on Linq Lane.
